These Terms of Service ("Terms") govern your access to and use of the InvestPHL website, applications, and services (the "Service"), operated by InvestPHL ("we," "us," "InvestPHL"). By creating an account or using the Service, you agree to these Terms.
InvestPHL provides real-estate development intelligence — parcel data, zoning analysis, valuation estimates, and related tools — derived largely from public records. The Service is an informational and analytical tool for real-estate professionals.
The Service does not provide legal, financial, investment, appraisal, tax, or brokerage advice. Valuations, "rational bid," deal-gap, and similar outputs are estimates based on assumptions and public data, which may be incomplete or inaccurate. You are solely responsible for independently verifying zoning, entitlements, title, condition, financials, and all facts, and for consulting your own attorneys, appraisers, and advisors before any transaction. Do not rely on the Service as the sole basis for any decision.
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. You must be 18+ and use the Service for legitimate business purposes.
Paid plans, where offered, are billed in advance on a recurring basis and are non-refundable except as required by law or expressly stated. Fees and plan features may change on notice. You may cancel at any time; access continues through the paid period.
Property, zoning, permit, and sales data are sourced from public records (e.g., City of Philadelphia open data) and third-party providers, and are provided "as is" without warranty of accuracy, completeness, or timeliness.
The Service, including its software, scoring models, compiled datasets, and branding, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Service per these Terms and your plan.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $100 IF NONE).
You agree to indemnify and hold us harmless from claims arising out of your use of the Service or violation of these Terms.
We may suspend or terminate access for violation of these Terms or misuse. You may stop using the Service at any time.
We may update these Terms; material changes will be posted here with a new "Last updated" date. Continued use constitutes acceptance.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Venue lies in the state or federal courts located in Philadelphia, Pennsylvania.
